Abstract

The study aims to assess the current situation and propose solutions to improve the efficiency of the implementation of the rights of land users in Vinh city. Using the random sampling method to select 240 land users who came to work at the Land Registration Office and 30 civil servants and officials involved in the implementation of the rights of land users. Using Likert's 5-level scale to assess the implementation of rights of land users. Research results show that in the period 2017 - 2020 in Vinh city, there were 62,588 transactions of mortgage of land use rights, 31,057 transactions of transferring land use rights, 2,058 transactions of gifting land use rights, 1,829 transactions of inheritance of land use rights and 24 transactions of leasing land use rights. The implementation of land use rights was mainly for residential land. The purpose of transferring and mortgaging land use rights was to invest in production and business and repay debts. The results of the survey of land users show that the ability to access services in implementing the rights of land users were assessed at a very easy level. Procedures performed at the Land Registration Office, time to complete the procedures; the collection of fees; the ability to implement regulations related to land use rights were assessed at a high level. The results of the staff survey showed that the quality of the cadastral records system was assessed at a good level. The documents guiding the implementation of land use rights were evaluated at a sufficient level. The level of publicity of administrative procedures; infrastructure; coordination among stakeholders; people's understanding of land law; the quantity and quality of staff were assessed at a very good level. To improve the effectiveness of the implementation of rights of land users, the following solutions should be implemented: solutions on mechanisms and policies; complete the system of cadastral records, technical equipment; improve the quality of human resources; solutions for propaganda, organization and implementation guidance.

Nghiên cứu nhằm đánh giá thực trạng và đề xuất giải pháp nâng cao hiệu quả thực hiện các quyền của người sử dụng đất (NSDĐ) tại thành phố Vinh, tỉnh Nghệ An. Sử dụng phương pháp lấy mẫu ngẫu nhiên để chọn 240 NSDĐ đến làm việc tại Chi nhánh Văn phòng Đăng ký đất đai và 30 cán bộ công chức, viên chức có liên quan đến việc thực hiện các quyền của NSDĐ. Sử dụng thang đo 5 mức của Likert để đánh giá việc thực hiện các quyền của NSDĐ. Kết quả nghiên cứu cho thấy trong giai đoạn 2017 - 2020 tại thành phố Vinh có 62.588 giao dịch thế chấp quyền sử dụng đất (QSDĐ), 31.057 giao dịch chuyển nhượng QSDĐ, 2.058 giao dịch tặng cho QSDĐ, 1.829 giao dịch thừa kế QSDĐ và 24 giao dịch cho thuê QSDĐ. Việc thực hiện QSDĐ chủ yếu đối với đất ở. Mục đích của chuyển nhượng và thế chấp QSDĐ là đầu tư sản xuất kinh doanh và trả nợ. Kết quả điều tra NSDĐ cho thấy khả năng tiếp cận dịch vụ trong thực hiện quyền của NSDĐ được đánh giá ở mức rất dễ. Thủ tục thực hiện tại văn phòng đăng ký đất đai (VPĐKĐĐ), thời gian hoàn thành các thủ tục; việc thu phí, lệ phí; khả năng thực hiện các quy định liên quan đến QSDĐ được đánh giá ở mức cao. Kết quả điều tra cán bộ cho thấy chất lượng hệ thống hồ sơ địa chính được đánh giá ở mức tốt. Các văn bản hướng dẫn thực hiện QSDĐ được đánh giá ở mức đầy đủ. Mức độ công khai thủ tục hành chính (TTHC); cơ sở vật chất; sự phối hợp giữa các bên liên quan; sự hiểu biết pháp luật đất đai của người dân; số lượng và chất lượng của cán bộ được đánh giá ở mức rất tốt. Để nâng cao hiệu quả thực hiện quyền của NSDĐ cần thực hiện các giải pháp sau: giải pháp về cơ chế, chính sách; hoàn thiện hệ thống hồ sơ địa chính, trang thiết bị kỹ thuật; nâng cao chất lượng nguồn nhân lực; giải pháp về tuyên truyền, tổ chức và hướng dẫn thực hiện.
