VAI TRÒ CỦA CÁC TỔ CHỨC TẬP THỂ TRONG XÂY DỰNG, QUẢN LÝ VÀ PHÁT TRIỂN CHỈ DẪN ĐỊA LÝ TẠI VIỆT NAM

Abstract

This study aimed to find out the role of collective organizations in stages of establishment, management and development of geographical indications (GIs) in Vietnam by utilizing desk study and in-depth interview. Research results showed that regulations on activities to establish protection rights for GIs, regulations on GIs owners are presented in the national legal system. However, specific regulations on the roles and responsibilities of state management agencies, collective organizations, and entities authorized to use GIs have not yet been recorded in the system. In addition, the participation of collective organizations in establishment, management and development of GIs has been still relatively limited, mainly represented by a supportive role. Based on the findings, recommendations on management approaches and policies to promote the role of organizations in were suggested in this study.

Nghiên cứu này nhằm tìm hiểu vai trò của các tổ chức tập thể trong xây dựng, quản lý và phát triển chỉ dẫn địa lý (CDĐL) tại Việt Nam thông qua nghiên cứu tài liệu và phỏng vấn sâu. Kết quả nghiên cứu cho thấy, Việt Nam đã có quy định về hoạt động xác lập quyền bảo hộ đối với CDĐL, quy định về chủ sở hữu CDĐL. Tuy nhiên, các quy định cụ thể về vai trò, trách nhiệm của các cơ quan quản lý nhà nước, các tổ chức tập thể, các chủ thể được trao quyền sử dụng CDĐL vẫn chưa được thể hiện trong hệ thống quy phạm pháp luật. Bên cạnh đó, nghiên cứu cũng chỉ ra rằng vai trò của các tổ chức tập thể trong quá trình xây dựng, quản lý và phát triển CDĐL còn hạn chế, chủ yếu mới ở mức tham gia hỗ trợ. Trên cơ sở các phát hiện, những khuyến nghị về quản lý và các chính sách hỗ trợ nhằm phát huy vai trò của các tổ chức trong xây dựng, quản lý và phát triển CDĐL cũng được đề cập trong nghiên cứu này.
