Abstract

The research results have assessed the status of land use and management in agricultural and forestry companies in Thai Nguyen province. By the end of 2019, the area of ​​agricultural and forestry land in the province (according to thedecision on land allocation) is 84,492.64 ha, of which the checked and being used area is 72,471.19 ha, the area has been granting certificate of land use rights is 48,000.25 ha, accounting for 56.81% of the area. The area of ​​unused land handed over to the locality is 19,979.71 ha, of which the provincial People's Committee has issued a decision to recover 10,731.05 ha and handed over to the People's Committees of districts for management and use. The remaining area has not documented to recover is 9,248.66 ha. In the process of land management and use, there is a phenomenon of land disputes between agricultural and forestry companies and local people, there is still unused land, most of the agricultural and forestry farms have not formulated land use plansyet.In the process of implementation still exist some difficulties that need attention and resolution.In order to intensify management and land use in the coming time, the study has proposed a number of solutions including: Completing legal policies related to the management and land use of land in agricultural and forestry companies; combine the arrangement and renewal of agricultural and forestry companies with the review of the land fund managed by agriculture and forestry farms; resolutely recover land areas that are not used or used ineffectively or encroached upon or occupied of agricultural and forestry companies and assigned to local management; To accelerate planning and adjustment of land use plans and promote the application of information technology in land management in agricultural and forestry companies.

Kết quả nghiên cứu đã đánh giá được thực trạng công tác quản lý sử dụng đất tại các công ty nông, lâm nghiệp trên địa bàn tỉnh Thái Nguyên. Tính đến hết năm 2019, diện tích đất công ty nông, lâm nghiệp trên địa bàn tỉnh (theo Quyết định giao đất) là 84.492,64 ha, trong đó diện tích đã rà soát và đang sử dụng là 72.471,19 ha, diện tích đã được cấp giấy chứng nhận quyền sử dụng đất là 48.000,25 ha chiếm 56,81% diện tích được giao. Diện tích đất không sử dụng các đơn vị bàn giao lại cho địa phương là 19.979,71 ha, trong đó 10.731,05 ha đã được UBND tỉnh ra quyết định thu hồi và giao cho UBND các huyện đưa vào quản lý sử dụng, diện tích còn lại chưa lập hồ sơ thu hồi là 9.248,66 ha. Trong quá trình quản lý sử dụng đất vẫn còn hiện tượng tranh chấp đất đai giữa công ty nông, lâm trường với người dân, vẫn còn đất chưa đưa vào sử dụng, hầu hết các công ty nông, lâm nghiệp chưa lập quy hoạch sử dụng đất. Trong quá trình thực hiện còn một số tồn tại khó khăn cần quan tâm giải quyết. Để tăng cường công tác quản lý sử dụng đất trong thời gian tới, nghiên cứu đã đề xuất một số giải pháp gồm: Hoàn thiện chính sách pháp luật liên quan đến công tác quản lý sử dụng đất tại các công ty nông, lâm nghiệp; gắn việc sắp xếp, đổi mới các công ty nông, lâm nghiệp với việc rà soát lại quỹ đất do công ty nông, lâm nghiệp quản lý, kiên quyết thu hồi những diện tích đất không sử dụng hoặc sử dụng không hiệu quả, bị lấn, bị chiếm để giao về địa phương quản lý; đẩy nhanh công tác lập, điều chỉnh phương án sử dụng đất và đẩy mạnh ứng dụng công nghệ thông tin trong việc quản lý đất tại các công ty nông, lâm nghiệp.
