GIẢI PHÁP NÂNG CAO HIỆU QUẢ CÔNG TÁC ĐĂNG KÝ THẾ CHẤP QUYỀN SỬ DỤNG ĐẤT, QUYỀN SỞ HỮU NHÀ Ở VÀ TÀI SẢN GẮN LIỀN VỚI ĐẤT TẠI HUYỆN HOA LƯ, TỈNH NINH BÌNH

Abstract

A study on the current status of registration of mortgage of land use rights, ownership of houses and other land - attached assets in Hoa Lu district, Ninh Binh province showed that: In the period 2016 - 2020, mortgage registration for land use rights, house ownership and other land - attached assets have registered 4,341 records. Security measures for mortgage with land use rights, house ownership and other land - attached assets are regularly implemented and registered by land users at the Hoa Lu district Land Use Right Registration Office Branch because the provisions of the law on registration of security measures are suitable for land users and are obeyed according to regulations. However, the facilities and human resources working at the Hoa Lu district Land Use Registration Office branch and the Department of Natural Resources and Environment of Hoa Lu district have not met the current demand for land management. In order to improve the efficiency of registration of transactions secured by land use rights, ownership of house and other land - attached assets, it is necessary to synchronously implement several groups of solutions such as: Solution to foster the contingent of officers who register security measures; solutions to propagate and improve the law on registration of security measures; solutions in performing the work of registration of security measures; solution to build a mechanism to exchange information on the legal status of security assets between the security transaction registration agency and relevant agencies.

Nghiên cứu thực trạng công tác đăng ký thế chấp quyền sử dụng đất (QSDĐ), quyền sở hữu nhà ở (QSHNƠ) và tài sản khác gắn liền với đất tại huyện Hoa Lư, tỉnh Ninh Bình cho thấy: Giai đoạn 2016 - 2020 công tác đăng ký thế chấp QSDĐ, QSHNƠ và tài sản khác gắn liền với đất đã đăng ký 4.341 hồ sơ. Các biện pháp bảo đảm về thế chấp bằng QSDĐ, QSHNƠ và tài sản khác gắn liền với đất được người sử dụng đất thực hiện và đăng ký thường xuyên tại Chi nhánh Văn phòng Đăng ký QSDĐ huyện Hoa Lư do các quy định của pháp luật về đăng ký biện pháp bảo đảm phù hợp với người sử dụng đất và được chấp hành theo quy định. Tuy nhiên, cơ sở vật chất và nguồn nhân lực làm việc tại Chi nhánh Văn phòng Đăng ký QSDĐ huyện Hoa Lư và Phòng Tài nguyên và Môi trường huyện Hoa Lư chưa đáp ứng nhu cầu trong quản lý đất đai hiện nay. Để nâng cao hiệu quả trong công tác đăng ký giao dịch bảo đảm bằng QSDĐ, QSHNƠ và tài sản khác gắn liền với đất, cần thực hiện đồng bộ một số nhóm giải pháp như: Giải pháp bồi dưỡng đội ngũ cán bộ thực hiện đăng ký biện pháp bảo đảm; giải pháp tuyên truyền, phổ biến pháp luật về đăng ký biện pháp bảo đảm; giải pháp trong thực hiện công tác đăng ký biện pháp bảo đảm; giải pháp xây dựng cơ chế trao đổi thông tin về tình trạng pháp lý của tài sản bảo đảm giữa cơ quan đăng ký giao dịch bảo đảm và các cơ quan có liên quan.
